Can a husband file for divorce?
Yes. Under Section 13 of the Hindu Marriage Act, 1955, a husband has the same legal right as a wife to seek a decree of divorce on any of the grounds specified in the Act.
A husband may file for divorce on grounds such as cruelty, adultery, desertion, conversion, mental disorder, venereal disease (subject to current law), renunciation of the world, or presumption of death, provided the statutory requirements are satisfied.
The Supreme Court has consistently held that the right to seek divorce is available equally to both spouses, subject to proof of the statutory grounds.
Apart from a contested divorce, the husband and wife may also jointly seek dissolution of marriage by mutual consent under Section 13B of the Hindu Marriage Act, 1955, if they mutually agree to end the marriage and fulfil the conditions prescribed under the Act.
